HOSPICE OF HUMBOLDT is committed to respecting the privacy rights of the users ("Users") of HOSPICE OF HUMBOLDT'S 'Heartfelt Messages' Website found at hospiceofhumboldt.org/heartfeltmessages/ (the "Site"). This Site Privacy Policy (this "Policy") was created and is intended to give you confidence as you visit and use the Site, and to demonstrate our commitment to fair information practices and the protection of privacy. This Policy is only applicable to the Site, and not to any other websites that you may be able to access through the Site, each of which may have data collection and use practices and policies that differ materially from this Policy. This Policy is incorporated by reference into the Terms of Use Agreement.

1.2. NOTICE CONCERNING CHILDREN

PLEASE NOTE: We are a general audience site, and do not direct any of our content specifically at children under 13 years of age. We understand and are committed to respecting the sensitive nature of children's privacy online. If we learn or have reason to suspect that a User is under age 13, we will promptly delete any personal information in that User's account.

2. INFORMATION COLLECTION PRACTICES

2.1. WHAT BASIC INFORMATION DOES HOSPICE OF HUMBOLDT COLLECT?

In operating the Site, HOSPICE OF HUMBOLDT may require registration by Users and may request that Users fill out online surveys and other online forms that ask Users to provide their names, mailing addresses, telephone numbers, and e-mail addresses.

2.2. WHAT ADDITIONAL INFORMATION DOES HOSPICE OF HUMBOLDT COLLECT?

(a) AUTOMATIC COLLECTION. Our servers automatically recognize visitors' domain names and IP addresses (the number assigned to computers on the Internet). No personal information about you is revealed in this process. The Site may also gather anonymous "traffic data" that does not personally identify you, but that may be helpful for marketing purposes or for improving the services we offer.

If HOSPICE OF HUMBOLDT or substantially all of its assets are acquired, information collected through the Site will be one of the assets transferred to the acquirer.

(f) ACCESS TO INFORMATION. Unfortunately, we do not maintain any procedures for you to review or request changes to the information that we collect about you, except that you may request that we remove all information about you from our database by contacting us in accordance with Section 6.1 below.

HOSPICE OF HUMBOLDT follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. The Site has security measures in place to prevent the loss, misuse, and alteration of the information that we obtain from you, but we make no assurances about our ability to prevent any such loss, misuse, to you or to any third party arising out of any such loss, misuse, or alteration.

5. WEBSITE AREAS BEYOND HOSPICE OF HUMBOLDT'S CONTROL

5.1. 'HEARTFELT MESSAGES' WEBPAGES ARE PUBLIC OR SEMI-PUBLIC FORUMS

The Site was designed and is intended as a free service to enable family, friends, and interested acquaintances of hospice patients to create and maintain online forums to share information about a patient's end of life status and for bereavement support to each other. Anyone who wishes to set up such an online forum, referred to as a 'Heartfelt Messages' Webpage ("User Page"), can do so at the Site. After registering with the Site, an "Author" (a category of User) is able to create a User Page by uploading User Content for viewing by other Users known as "Visitors". Depending on the security level selected by the Author, certain Visitors will be allowed to visit the User Page and post User Content as well. The User Content of any and all User Pages is posted autonomously by any User (Authors and/or Visitors) without the aid, review, editing or involvement of HOSPICE OF HUMBOLDT. Because the primary focus of User Pages revolves around the status of loved ones during their final days of life, it is likely that such information about a patient will be shared and displayed to family and friends, and, depending on the privacy level selected by the Author, to the public. Such User Content is provided at the sole instigation and under the sole control of the User. HOSPICE OF HUMBOLDT, who does not control, edit, monitor or otherwise evaluate the suitability of such User Content for public consumption takes no responsibility for such User Content and assumes no liability for any User Content submitted by Users. All User Pages are User-generated and controlled. Any User Content disclosed in these User Pages becomes public or semi-public information and you should exercise caution when deciding to disclose your personal information or personal information about others.

5.2. THIRD PARTY WEBSITES

The Site may contain links to other websites. If you choose to visit other websites, we are not responsible for the privacy practices or content of those other websites, and it is your responsibility to review the privacy policies at those websites to confirm that you understand and agree with their policies.
